Terms and Conditions

These Terms and Conditions apply to tree surgery, tree removal, pruning, hedge and shrub work, stump grinding and related services provided by TreeCut.

1. About us

In these terms, “we”, “us” and “our” mean TreeCut. “You” and “your” mean the customer named in the quotation.

2. Quotations and acceptance

Our quotations are based on the information and access available when the work is assessed. Unless stated otherwise, quotations are valid for 30 days.

A quotation covers only the work specifically described in it. Any additional work requested by you, or required because of previously undisclosed conditions, will be discussed and priced separately.

By accepting our quotation, you confirm that you have read and accepted these Terms and Conditions.

3. Deposits and booking confirmation

A deposit is required before any work is scheduled or carried out. The amount of the deposit will be stated in your quotation or booking confirmation.

Your proposed work date is not secured until we have received the required deposit in cleared funds. We may decline to begin work if the deposit has not been paid.

A deposit is a payment towards the total agreed price and will be deducted from the final balance.

If a booking is cancelled, we will only retain an amount that reasonably reflects costs already incurred and any direct loss caused by the cancellation. We will take reasonable steps to reduce that loss. Any remaining deposit will be refunded.

4. Final payment

Unless we have agreed otherwise in writing, the remaining balance must be paid in cleared funds either:

  • when requested before completion of the work; or
  • immediately upon completion of the work.

In every case, full payment must be received on the same calendar day that the work is completed. Payment may not be delayed until a later date.

Issuing an invoice does not extend the payment deadline unless a different deadline has been agreed by us in writing.

If you believe that any part of an invoice is incorrect, you must tell us immediately. Any amount that is not genuinely disputed must still be paid on the due date.

We reserve the right to suspend work until any payment that has become due is received.

5. Scope of work

We will perform the work described in the accepted quotation with reasonable care and skill.

Photographs, measurements and descriptions supplied by you must accurately represent the site and the work required. If the circumstances on arrival are materially different, we may revise the quotation or postpone the work.

Unless expressly included in the quotation:

  • rebuilding, landscaping, turfing, planting and making good are not included;
  • timber, woodchip and other waste will be removed only where this is stated;
  • holes left by removed trees or shrubs will not be filled with imported soil; and
  • underground services, structures and obstructions will not be moved or repaired.

6. Stump and root grinding

Where stump grinding is included, we will grind the stump and accessible exposed roots within the quoted working area and to the depth stated in the quotation, up to a maximum of approximately two feet below the surrounding ground level where conditions safely allow.

Holes will not be excavated. We remove the main root ball and accessible exposed roots in the immediate working area, but roots extending underground beyond that area are not included unless expressly stated in the quotation.

The achievable depth may be restricted by underground services, concrete, stone, metal, restricted access or other concealed obstructions.

Stump grinding does not guarantee the complete removal of every root, prevent all future growth or make the area immediately suitable for construction or replanting.

7. Access and customer responsibilities

You must provide safe and reasonable access to the site on the agreed date, including any necessary access through neighbouring property.

Before work begins, you must:

  • remove vehicles, furniture, ornaments and other movable items from the working area;
  • keep children, pets and other people away from the work zone;
  • tell us about underground or concealed services, including electricity, gas, water, drainage, irrigation and communications cables;
  • disclose any known hazards, restrictions or access problems; and
  • obtain any permissions for access through land that you do not own.

Additional costs caused by unavailable access, undisclosed hazards or inaccurate information may be charged where those costs are reasonable and explained to you.

8. Ownership and permissions

By instructing us, you confirm that you own the trees, hedges or shrubs concerned or have authority from the owner to commission the work.

Work may require consent because of a Tree Preservation Order, conservation-area controls, planning conditions, tenancy terms or property restrictions. The quotation should state whether you or TreeCut will be responsible for checking and obtaining the necessary permission.

You must disclose any restrictions known to you. We will not knowingly carry out unlawful work and may postpone or cancel work if the necessary permission has not been obtained.

Work may also be postponed or changed where necessary to protect nesting birds, bats or other legally protected wildlife.

9. Changes and additional work

Any change to the agreed work should be confirmed in writing where practicable.

Additional work will be charged separately. We will explain the additional cost and seek your agreement before carrying it out, except where immediate action is reasonably necessary to make the site safe.

10. Cancellations and cooling-off rights

Please contact us as soon as possible if you need to cancel or rearrange your booking.

If you are a consumer and the contract was agreed online, by telephone or away from our business premises, you will normally have a legal right to cancel it within 14 days of entering into the contract.

If you ask us to begin work during that 14-day period, we will require your express request. If you subsequently cancel after work has started, you may be required to pay a proportionate amount for the work already supplied.

If the work is completed during the cancellation period following your express request and acknowledgement, your legal right to cancel may end once the service has been fully performed.

Outside any statutory cancellation right, deductions from a deposit or cancellation charges will be limited to reasonable costs and direct losses resulting from the cancellation. These terms do not affect your statutory rights.

11. Cancellation form

You may use the following wording, although you do not have to:

12. Delays, weather and unsafe conditions

Tree work is affected by weather, ground conditions, access, equipment availability and safety considerations. Start times and completion dates are estimates unless expressly guaranteed in writing.

We may postpone or suspend work where conditions are unsafe or circumstances outside our reasonable control prevent us from working.

We will arrange a new date as soon as reasonably practicable. If a substantial delay occurs and no reasonable alternative date can be agreed, either party may cancel the outstanding work. Any payment for work not supplied will be refunded, less any reasonable amount due for work already completed.

13. Site condition and clean-up

We will take reasonable care to minimise disruption and will leave the working area reasonably tidy.

Tree work, machinery and the removal of heavy material can cause unavoidable disturbance to lawns, soil, paths and surrounding vegetation. We will not be responsible for unavoidable minor disturbance inherent in carrying out the agreed work, provided that we have exercised reasonable care and skill.

Unless the quotation states otherwise, the removal of waste, timber, logs, branches, woodchip and stump grindings is not included.

14. Damage and liability

You must tell us before work begins about fragile surfaces, concealed structures, underground services or property that may be affected.

We are responsible for loss or damage that is a foreseeable result of our failure to exercise reasonable care and skill. We are not responsible for pre-existing damage, concealed defects or loss caused by inaccurate or incomplete information supplied by you.

Nothing in these terms excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or your statutory consumer rights.

If you are using our services for domestic purposes, we are not responsible for business losses such as lost profits, lost income or loss of business opportunity.

15. Complaints

If you have a concern about our work, please contact us promptly so that we have a reasonable opportunity to inspect the work and, where appropriate, put the matter right.

Making a complaint does not affect your statutory rights.

16. Personal information

We will use your personal information to prepare quotations, manage bookings, provide services, process payments and communicate with you.

17. Your statutory rights

Nothing in these Terms and Conditions affects the rights given to consumers by law, including the right to receive services performed with reasonable care and skill.

18. Governing law

These Terms and Conditions are governed by the laws of England and Wales.

If you are a consumer, you retain any mandatory legal protections that apply where you live and may bring proceedings in the courts available to you under applicable law.

19. Changes to these terms

We may update these Terms and Conditions occasionally. The version that applies to your booking will be the version supplied or made available when you accept the quotation.
